New publication of Ernst J. Brem

In the September issue of the journal sic!, our attorney Ernst J. Brem publishes an article on the highly critical topic of "Artificial intelligence and artistic performance", in collaboration with Ernst W. Brem.

"Current AI systems are able to change artistic performances in music, film and other media or create the illusion of new performances that have never actually taken place. For performing artists, this leads to profound upheavals in their professional activities. For many, the question arises as to whether their professional field will still exist in the future given the rapid pace of technological development. This article analyzes the legal remedies available to performing artists in Switzerland de lege lata against the unauthorized use of their services through the application of artificial intelligence. It also examines the possibilities of contractually regulating the use of artistic performances by AI systems. It then discusses ways in which the existing possibilities for protection can be usefully supplemented de lege ferenda."
